The amount of settlement for a brain injury would have to depend on how smart the person was to begin with….
Some of the factors that could be considered.
1) Lost work time due to injury and recovery
2) Lost time for home and family involvement (when they were injured, who cooked dinner/took the trash out/fixed the leaky faucet)
3) If there is some permanent disability, retraining for another job
4) If new job doesn’t pay as well, or have as good prospects, then loss of income over future working life. Also loss of benefits resulting from lower compensation.
5) Medical insurance on future complications due to the injury.
If an attorney is already involved, the attorney should work with an economics expert witness. They can precisely calculate the damages based on the individual case.
