Should the parents file a lawsuit against the baseball bat makers?
SamSam asked:
In 2006, a healthy boy was playing baseball… pitching in fact. His father was the team’s coach. He got hit by a line drive straight to the chest which stopped his heart and subsequently caused permanent brain damage. His parents are suing the baseball bat manufacturer, the Little League and the store that sold the bat. It was aluminum which reportedly makes the ball fly faster. The parents are suing the bat manufacturer, the Little League and the store that sold the bat… contending that the company disregard for player safety by making an aluminum bat.

Their punishment when they LOSE the lawsuit should be being beaten with that very bat. Idiots.
I would imagine these are the same types of parents who believe banning guns will stop violence. Geez.
I feel horrible for their suffering, it must be awful. There is no lawsuit there though.
that is pretty ridiculous. i got hit in a car i think i will sue Ford
They shouldnt sue anything.
THey should be helping their son.
No, it’s crap. My kid was pitching (age 12) got nailed with a line drive to the face, badly injured. We had to sign a waiver to play baseball, they probably did as well. They are just frustrated.
My other son at age 16 was knocked out from a pitch, spent a week in the hospital. Yes he was wearing a helmet.
i think the family is completely wrong in this situation- theyre just trying to make money off of this terrible thing that happened even though everyone knows the dangers of baseball
of course not!
its ridiculous how people’s first instinct is to sue instead of try and do all they can to help their son. besides if they’re going to sue someone then it should be the family of the kid that hit him with the ball (although i’d find that equally outrageous)
People are sue happy. No they shouldn’t sue the people, they took the chance when they let him play ball, accidents happen
first of all, why is it your concern in the first place? Second, take some responsibility it’s a sport, it’s a bat, and don’t you know the difference between wood and aluminum? it’s not like it was disguised as a weapon.
That would be like suing a gun manufacturer because someone was shot—–sue the person who pulled the trigger, not the object.
Almost anything can be used as a weapon, whether intentional or not. Sometimes, no one is at “fault” because the act was an accident—-or an act of negligence.
There is always a certain amount of risk associated with certain activities, whether it be skydiving, crossing the street at a busy intersection, or playing baseball. A person assumes all risk when they choose to participate in a certain activity. It sounds like this act wasn’t intentional, so the parents are simply looking for someone to blame. If harm’s done, automatically people look for who to place the blame on…..in this case (because the act seemed unintentional) the easy target was the baseball bat manufacturer.
That’s insane. They’re just angry that their son isn’t going to be “normal” again. They sound like kids! They need to realize that trying to scam a bunch of people because of an ACCIDENT is not going to help their son in any way. I’m sure they’re not very helpful to him.
Anybody can sue anyone in the States. All it takes is court fees.
In a case like this it’s standard practice for the lawyers to sue everybody in sight in the hopes somebody will settle rather than take it to trial. Some may and some may not.
As l understand it there are also dangers with wooden bats…
Anyway that’s what courts and lawyers and judges and juries are for.
My personal opinion is that if gun manufacturers are allowed to make armament suitable for personal use this suit is ridiculous. But…l’m no lawyer.
However, the fact is that this family is incurring enormous medical bills due to this injury and the kid’s future earnings are compromised by brain injury, so it is understandable that they owe it to themselves to get whatever compensation they can. l can’t imagine anyone who would not were it to happen to them.
