o-k, my husband was in a car accident where he was the passenger. The driver died and my hubby was in a coma for 3 1/2 months and racked up medical bills that currently stand at half a million dollars. He didn’t have insurance and Medicaid picked up the tab. We settled with the insurance company for $75,000 (that was the max we could get) and the attorney gets a third of that, which leaves $50,000 that Medicaid is trying to take as reimbursement. We filed a suit requesting a hearing for a judge to hear our case and decide if and how much we will get. Now, a little bit about how my husband fared after waking up: He has a traumatic brain injury (TBI), difficulties with speech and short term memory, and some physical limitations such as a slight limp, favoring of the right arm, and his body has troubles regulating his body temperature. His eyesight was literately knocked off balance, and due to delayed reflexes, is not allowed to drive at present. Do you think there is a chance the judge could rule in our favor?

J asked: I was rearended pretty badly about two months ago. My Ford Focus was completely totaled by a Chevy Trailblazer. I’ve been going to PT for the whiplash injury to my neck and shoulder. I have also had some loss of cognitive function(which is slowly recovering), anxiety issues, loss of sleep, and constant head aches. My PCP has ordered CT scans and MRI of my brain, both came back normal. So now he is reffering me to a neurologist. What can I expect from this, in terms of treatment.
I have read many conflicting opinions about what happens to the brain(if anything) during whiplash. There is no lawsuit, as this was a genuine accident and I presume all medical bills lost wages will paid in full.
I look forward to any insight the community can provide.

anon asked: My husband received practically nothing (around 2000 of the expected 75,000 (I’ve factored in medical expenses paid for) thanks to an incompetent attorney who rarely returned his calls. My husband, before I met him, was in a car accident a few years ago that was the other driver’s fault, and suffered massive injuries to the head/brain, face, and body. He practically died (had death experience but came back because it wasn’t his time). He lost his firefighter and potential stuntman career and is now on disability.
Someone with legal expertise, please tell me….can my husband legally have this case reopened or a new case involving the accident filed by a different, hopefully better, lawyer?

my husband accepted the award check I think because
1) having suffered head trauma, he doesn’t think as fast on his feet as before the accident, and
2) the attorney was sneaky and rarely returned his calls, kept my husband in the dark about the case so my husband did not know what was up, when they met for the settlement.

It is a workers comp case and EVERYTHING concerning his care and needs is a fight. They have a workers comp lawyer who they have had for 2 yrs this june and he has not gotten them anything. It seems like the lawyer is working for the other side. He rarely returns phone calls and is always defending workers comp. we dont know who to talk to in order to get anyting done. And after a certain amout of time you can not have you lawyer with draw. Does anyone know of someone who may be able to help?
